Aussie Land & Livestock – Online Auction Terms & Conditions (Effective for all auctions conducted via Bidsonline.com.au)
1. General 1.1 These Terms and Conditions (“Terms”) govern participation in all online auctions conducted by Aussie Land & Livestock (“the Auctioneer”) via the Bidsonline.com.au platform. 1.2 By registering to bid, accessing the online auction system, or placing a bid, all participants agree to be legally bound by these Terms. 1.3 These Terms are governed by the laws of Queensland and the Commonwealth of Australia, including the Property Occupations Act 2014 (QLD) and the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).
2. Eligibility to Bid 2.1 All bidders must be aged 18 years or older and legally capable of entering into a binding contract. 2.2 Bidders must register on the Bidsonline platform using accurate and up-to-date information, including valid identification and contact details. 2.3 Aussie Land & Livestock reserves the right to decline or revoke any registration or bid at its sole discretion, without obligation to provide reasons.
3. Auction Process 3.1 Each auction will start and end at the times specified on the auction listing. 3.2 The highest bid at the closing time will be deemed the winning bid, provided it meets or exceeds the reserve price (if applicable). 3.3 The Auctioneer reserves the right to: - Set a reserve price;
- Withdraw, postpone, or re-offer any lot at any time before the auction closes;
- Reject any bid not deemed to be in the vendor’s best interest.
3.4 Bidders acknowledge that technical difficulties, internet delays, or system outages may occur. The Auctioneer is not responsible for any failed or late bids due to these issues.
4. Bidding Rules 4.1 All bids placed are final, irrevocable, and legally binding. 4.2 Proxy or absentee bidding may be permitted with prior arrangement. 4.3 Shill bidding or manipulation of the auction process is strictly prohibited and may result in legal action under the Australian Consumer Law. 4.4 In the event that two identical bids are placed, the bid with the earliest timestamp will take precedence.
5. Successful Bidders 5.1 Winning bidders will be notified via the platform and/or email at the conclusion of the auction. 5.2 A binding contract is formed at the close of the auction. The winning bidder must complete the transaction, including signing any required documents and paying in accordance with the invoice terms. 5.3 Title and risk of the item pass to the buyer only upon receipt of full cleared payment unless otherwise stated. 5.4 If another party places a bid using your login credentials, you may still be liable for any resulting transaction.
6. GST and Buyer’s Premium 6.1 All bids are exclusive of GST unless otherwise noted in the listing. GST will be applied where applicable. 6.2 A Buyer’s Premium may apply and will be clearly stated in the individual auction listing.
7. Item Condition and Representations 7.1 All items are sold "as is, where is" unless expressly stated otherwise. 7.2 No warranties or guarantees are provided by the Auctioneer regarding condition, fitness for purpose, or accuracy of descriptions, unless required under Australian Consumer Law. 7.3 Photos and written descriptions are intended as a guide only and may not reflect the exact condition or completeness of the item.
8. Disputes 8.1 The Auctioneer’s decision is final in the event of any dispute regarding bidding or auction outcomes. 8.2 If a post-auction dispute arises, all parties agree to attempt to resolve it in good faith. If unresolved, the matter may be subject to applicable legal processes.
9. Limitation of Liability 9.1 The Auctioneer and Bidsonline are not liable for: - Bids not received, processed, or accepted due to technical issues;
- Platform outages or errors;
- Interruptions or capacity limitations on the auction system;
- Unauthorised use of bidder accounts;
- Any other failure of technology, connectivity, or software.
9.2 To the extent permitted by law, liability for breach of any implied condition or warranty is limited to refund or resupply of the affected item.
10. Privacy 10.1 Personal data collected during registration and bidding is managed in accordance with the Privacy Act 1988 (Cth). 10.2 By registering, bidders consent to the collection, storage, and use of their data for auction-related purposes and communications.
11. Outbid Notifications 11.1 Bidders will receive an automatic email if outbid. Aussie Land & Livestock is not responsible if this email is delayed or not received.
12. Changes to Terms 12.1 These Terms may be updated at any time without prior notice. It is the bidder’s responsibility to review the current Terms prior to bidding.
